Elastic Sync (“Service”) is a software as a service (SaaS) provided by Hage Digital℠, licensed under Little Fruity Pty Ltd. These Terms of Service (“Terms”) govern your access and use of the Service, which is accessible via integration with your Shopify store.

By installing or using Elastic Sync, you agree to be bound by these Terms. If you do not agree, do not install, access, or use the Service.

•“Shopify Store” refers to any Shopify storefront or account where Elastic Sync is installed.

2. Eligibility

By using Elastic Sync, you confirm that you are at least 18 years of age and have the legal authority to bind the entity (e.g., your business) that owns or operates the Shopify store using the Service.

3. Service Description

Elastic Sync is a tool designed to connect and synchronize your Shopify store with external systems and apps as specified. Features may include, but are not limited to:

•Automated data synchronization

•Real-time updates between Shopify and other platforms

•Access to reporting and analytical tools

We reserve the right to modify or discontinue the Service (in whole or part) at any time, without notice.

4. Account Registration and Access

To use Elastic Sync, you must register through Shopify, allowing us to access your Shopify account via their API. You agree to provide accurate, current, and complete information and promptly update it as necessary.

Access to your Shopify account and data will be governed by Shopify’s API permissions, and your continued use of Elastic Sync is subject to compliance with Shopify’s terms and conditions.

5. License to Use

We grant you a limited, non-exclusive, non-transferable, and revocable license to use Elastic Sync solely for your internal business operations in connection with your Shopify store.

6. Fees and Payment

Elastic Sync may be offered as a paid service with subscription fees. You agree to pay all applicable fees according to the payment terms outlined at the time of installation or subscription. Failure to pay fees when due may result in termination or suspension of your access to the Service.

7. Data Collection and Usage

By using Elastic Sync, you consent to the collection, storage, and processing of data related to your Shopify store. This data may include, but is not limited to, order information, customer data, and product details. We use this data solely for the purpose of providing the Service.

We will never sell or share your data with third parties unless required by law or as part of an authorized data processing agreement.

8. Data Security

We take data security seriously and employ measures to protect your Shopify store’s data. However, you understand and agree that no method of electronic storage is completely secure, and we cannot guarantee absolute security.

9. Termination

You may terminate your use of Elastic Sync at any time by uninstalling the app from your Shopify store. We reserve the right to terminate or suspend your access to the Service if you breach these Terms or engage in unlawful activities.

Upon termination, all licenses granted under these Terms will immediately cease, and you will lose access to any data and services provided by Elastic Sync.

10. Limitation of Liability

To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or use, even if we have been advised of the possibility of such damages.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available.” We do not make any warranties, whether express or implied, regarding the reliability, accuracy, or completeness of the Service. You use the Service at your own risk.

12. Indemnification

You agree to indemnify, defend, and hold harmless Hage Digital℠, Little Fruity Pty Ltd., and their respective affiliates from any claims, damages, liabilities, costs, or expenses arising out of your use of Elastic Sync, breach of these Terms, or violation of any rights of third parties.

13. Governing Law
